Marsabit man jailed for six months over abusive SMS

A Marsabit court has fined a man Sh 20,000 or six months imprisonment in default for sending a woman an abusive message through his mobile phone.

Sora Dabaso Godana pleaded guilty to texting Didu Sora an insulting message that he generated from his mobile phone.

He was accused of committing the offence on August 11, this year by sending the complainant an offensive text that referred to her as a prostitute contrary to the telecommunications act.

“Malaya wewe sitakuwacha mpaka uwachane na dadangu (You are a prostitute, I will not leave you until you leave along my sister)”, the message in contention read in part.

Principal Magistrate Boaz Ombewa termed the offence committed as serious which deserved a deterrent sentence.

The magistrate ordered that the accused should serve six months in jail in case he failed to raise the fine.

The complainant who is a civil servant working in Marsabit is the estranged wife of a chief officer with the Marsabit County government’s education department with whom she is engaged in a divorce case.

The accused reportedly sent the message to the complainant in support of the husband’s new companion with whom he his remotely related.
