Kisumu woman fined for sending abusive texts

A Kisumu Chief Magistrate Court has fined a 23-year-old woman Sh10, 000 after she was found guilty of sending offensive text messages.

The court on Monday heard that, Purity Aluoch, insulted Mary Marina through text messages claiming the complainant was having an affair with her ex-boyfriend.

Marina told the court that, Akinyi was accusing her wrongly because she did not have any sort of relationship with her ex-boyfriend.

She said that the said boyfriend only visited her once at her Nyalenda home to seek help on how he can patch things up with Akinyi.

Akinyi is said to have send the text messages on different dates between September and October last year, and Marina said that she got offended and decided to seek legal address.

In her defence, Akinyi told the court that, she was sure Marina, her former friend, was having an affair with her ex-boyfriend and she reacted just like any ordinary woman in her situation.

However, chief magistrate, Catherine Owino, dismissed her defence terming it as not logical.

“It is not logical to act in the manner which you acted. Insulting somebody over something that is not confirmed should not be a way of solving our differences. This country has laws which must be followed no matter what situations we are faced with,” said Owino.
